Persons with assets who are contemplating marriage should seriously consider obtaining a pre-nuptial agreement. This is especially true concerning mature marriages when one or both parties have children from a prior marriage. It also applies to couples living together without being officially married. See Section on Relationships Between Unmarried Couples. Do not avoid looking into a pre-nuptial agreement because you are afraid it will be taken as unseemly or unromantic. It is foolish not to enter into a pre-nuptial agreement if one or both of you have prior assets. At McPherson & McPherson, we can prepare a pre-nuptial agreement to fit your situation which will not be offensive to either party.
